MY DECISION TO BECOME AN AUTHOR/ ENTREPRENEUR!
In 2008 during my court proceedings I learned through my attorney that I was being enhanced under the CAREER CRIMINAL statue.
In order to be enhanced as a career criminal the defendant must have at least two prior felony convictions for either a drug crime, a crime of violence, or a combination of the two.
I had a crime of violence conviction and a federal drug conviction. With the enhancement of being a career criminal I no longer faced 77 to 96 months, I now faced 188 to 262 months. Imagine knowing you will be serving the next 15.8 years or 21.10 years in a federal prison for an ounce of crack cocaine. Weeks later I learned from my attorney that another enhancement was looming and that I could potentially be enhanced again thus time under 21 U.S.C. § 851.
To trigger these enhanced penalties, a prosecutor must file an information providing notice of which prior convictions support the enhanced penalties. The "851" enhancement is one of the most severe penalties the federal government has in there arsenal.
What makes the 851 so feared is that it actually doubles your sentence. So under my situation that enhancement would of put me in the category of 360 months to life.
Just the thought of the 851 enhancement being a possible death sentence forced me to take a Nolo Contenders plea.
A Nolo Contenders plea is rare in federal criminal cases. In a Nolo Contendere plea, the defendant does not admit his factual guilt, but accepts the punishment on the premise that the government's evidence is strong enough for a conviction.
I was sentenced to 188 months. Thats when the process of me committing to a change for the better began. I spent alot of time writing and focusing on my growth. I used my writing as a stress reliever and it enabled me to block out the monotony prison life.
While I was going on my 12th year incarcerated I was released under the "First Step Act". Upon my release I was able to enroll in "Project Entrepreneur" at Boston College.
Project Entrepreneur is a course that teaches law students how to help prisoners transitioning out of incarceration develop the skills to start their own businesses.
I graduated Project Entrepreneur in the fall of 2019 and started my business, Unseen Handz Media.
